Can a Logo be trademarked?
The trademark protection can apply to logos as it is an identifying sign of the mark identity. In order to be registrable as a mark, the logo has to be distinctive and not descriptive of the type of product or service. For example, the word BREAD would not be registrable as a mark for bread and bakery, because members of the public need to use the word bread to describe the product. The only exception to this is when the mark is highly visually distinctive. For example, if you were to use the name BREAD with a dominant and eye-catching logo so that the most distinctive element is the look of the logo itself and not the word, this would be allowed. You would not be able to prevent anyone using the name BREAD, but you would be able to stop anyone using a similar visual logo. It is important to note that the trademark will only protect the logo within a specific territory and trading sector.
